Biography

    Kon is a partner in Gilbert + Tobin's Energy and Infrastructure group.

    He is an accomplished construction and infrastructure lawyer who has an acute understanding of the legal, technical and commercial issues that underpin successful project delivery. Kon provides strategic advice to market participants on the structuring, negotiation, drafting and administration of contracts across a broad range of projects, including: renewable energy projects, oil and gas facilities, process plants, residential (including social and affordable housing projects) and commercial developments, rail, roads, bridges, tunnels, airports, hospitals, schools and sporting facilities.

    Kon also has extensive experience in dispute management and resolution in the energy and infrastructure sectors and has a proven track record in determining and delivering strategies that result in early and effective resolution of complex and high-value disputes.  Where early resolution is not possible, Kon has demonstrated the ability to run and achieve successful outcomes for his clients in litigation and arbitration (across all forums and jurisdictions). He effectively manages a team of lawyers to ensure that those disputes can be run strongly and effectively. This includes recently acting in a billion-dollar international arbitration on the Icthys Project in the Northern Territory, as well as several high-profile Supreme Court and Court of Appeal proceedings in New South Wales, Victoria and Western Australia.  

    Kon is consistently recognised in the various legal directories. Recently, he was identified as a leading construction lawyer in the global and domestic editions of Who's Who Legal. He is recognised by his peers as a Leading Construction Lawyer in the current Australian edition of Best Lawyers, Legal 500 and has been named by Doyle’s Guides as a Leading Construction & Infrastructure Lawyer for the last eight years. In its 2023 edition, Legal 500 recognised Kon as a “next generation partner” in the area of construction and infrastructure disputes. One client quoted that Kon “is highly strategic in his approach and truly a ‘hands on’ partner.  We are very comfortable entrusting him to guide us though business-defining disputes.

    Kon holds a Bachelor of Commerce and Bachelor of Laws (with first class honours) from the University of NSW.
