Zac Kerr

Biography

Zac is a partner in our Energy and Infrastructure group.

He advises on projects and infrastructure transactions globally, particularly in Australia, New Zealand and Asia. He has a particular knowledge of the transport, energy, renewables, water and social infrastructure / public–private partnership (PPP) sectors, including greenfield contracting, financing and secondary markets.

Zac has advised on every privately owned toll road in Australia (together with a number of international road projects). He has also advised on the majority of the PPPs undertaken in Australia and New Zealand (together with a number of offshore PPPs). He has advised on dozens of electricity generation, distribution, transmission and storage projects. He is also experienced in advising clients lending to or buying and selling stakes in these assets.

His clients include sponsors, financiers and construction and O&M contractors on PPPs, toll roads, power stations, renewable projects, transmission and distribution assets, rail, ports, airports, telecommunication and industrial projects in Australia, New Zealand, developing and developed Asia, UK and Europe and the United States.

Experience

Zac’s experience includes advising:

  • AusNet Services on the 100km transmission extension and connection for the A$500 million Stockyard Hill Wind Farm, and various renewable connection arrangements including Crowlands, Bungala, Bulgana, Wangaratta, Glenrowan, Aggreko, Carwarp, Frasers, Hills of Gold, MREH, Barnawartha and Maffra.

  • Elecnor SA and Elecnor Australia as EPC contractor on all aspects of the A$2 billion Project Energy Connect electricity transmission project for Transgrid, including upstream and downstream contracting aspects, delivery aspects and managing out insolvent joint venture partner Clough while keeping the project on track.

  • EDP Renewables on all aspects of its development of the Punchs Creek BESS and solar farm in Queensland, including capacity purchase agreement with CS Energy and all procurement and delivery aspects.

  • Acciona on the project development and procurement aspects of its 1,026MW MacIntyre Wind Farm.

  • Pacific Blue on the project development and power purchase agreement aspects of its 195MW Portland Wind Farm.

  • EnergyAustralia on its acquisition and development of various wind, solar, pumped hydro and gas fired opportunities, its A$2 billion acquisition of the Delta Western GenTrading contract and conversion to full ownership and operation, and development of its Kanmantoo and Cultana pumped hydro assets.

  • Tetris / John Holland consortium on all aspects of its bid for the A$900 million New Melton Hospital PPP.

  • Amber / Watpac / Spotless consortium on all aspects of its successful bid for the Victorian Schools II PPP, together with subsequent dealings and augmentations.

  • ISS as FM contractor on its successful bid with Tetris Capital for the SA Scholls II PPP, and its bids with Tetris Capital for the New Footscray Hospital and Geelong Convention Centre.

  • Various clients on project development and procurement aspects of every toll road in Australia (26 projects), and more than 15 major Australian rail projects, with aggregate procured EPC value significantly exceeding A$100 million.

  • Transurban on all aspects of its development of the A$3 billion NorthConnex motorway tunnel with partners QIC and CPPIB, and all aspects of the related augmentations of its Lane Cove Tunnel and Hills M2 Motorway, together with subsequent dealings and augmentations.

  • IFM Investors on all aspects of its bid to acquire Queensland Motorways (6 toll road concessions).
