Tim O'Leary

Biography

Tim is a partner in our Disputes and Investigations group and is the partner in charge of our Perth office.

He specialises in resolving complex disputes, contentious restructuring matters and managing regulatory investigations. Tim appears regularly in the Supreme Court of Western Australia and the Federal Court of Australia and also practices in the Mining Warden's Court.

He provides advice on all aspects of corporate, commercial and resources and energy law.

Experience

Tim’s experience includes advising:

  • Mitsui & Co on complex, multi-party Federal Court proceedings relating to Mitsui’s operations at Onslow, Western Australia.

  • Kidman Resources and leading its successful defence of a Supreme Court claim over its globally significant Earl Grey lithium deposit valued at more than $900 million.

  • Aurora Oil & Gas regarding Baytex Energy Corp’s $2.4 billion acquisition of Aurora’s shares by Court approved scheme of arrangement.

  • Mighty River International regarding its successful application as a shareholder for inspection of a company’s books under s.247A Corporations Act 2001: Mesa Minerals v Mighty River International (2016) 241 FCR 241.

  • Ora Banda Mining Ltd and its subsidiaries regarding numerous successful applications to the Supreme Court of Western Australia for judicial review of decisions made under the Mining Act 1978 (WA).

  • Mitsui & Co on a successful application under s.111A of the Mining Act 1978 (WA) to the Minister for Mines to terminate mining tenement applications over Mitsui’s state agreement mining tenure at Onslow, Western Australia.

  • An internationally based steel fabricator in a private arbitration regarding construction of equipment for FMG’s Ironbridge Project in the Pilbara region of Western Australia (on-going).

  • Ora Banda Mining Ltd in a private arbitration regarding the refurbishment of its gold processing plant.
