Tim Gole

Biography

Tim is a partner in our Technology and Intellectual Property group.

He has significant experience working on information technology, telecommunications and broadcasting matters, such as outsourcing, systems integration, cloud and platforms, payment system arrangements and data arrangements. Tim’s work in this area spans the entire life cycle of projects, from procurement, contracting and negotiation, contract management, and disputes (including software audits and disputes). Tim works across the entire set of contract documentation, not only the front-end terms but also assisting in the development and negotiation of service descriptions, service levels, governance regimes and pricing documentation.

Tim also works on novel and complex contracting matters generally, including strategic alliance arrangements, distribution agreements and concession agreements.

Tim is highly experienced in the regulatory areas related to the above areas of practice, particularly privacy and data, and consumer law issues (with a particular focus on unfair terms, including compliance reviews and responding to regulatory investigations).

Experience

Tim’s experience includes advising:

  • An Australian Big-Four Bank on various strategic IT programs, including white-label agreements, fraud monitoring solution procurement, new payment products and cloud sourcing projects. 

  • Various clients on their outsourcing arrangements, including two of Australia’s big-four banks, Rest Super, Perpetual, The Travel Corporation, Carnival, ClearView and Xero. 

  • AP+ (the merger of BPAY, eftpos and the New Payments Platform) on various matters including a major project to harmonise the scheme rules for BPAY, eftpos and the New Payments Platform, and the introduction of Osko. 

  • PwC for many years on various projects, including its reselling of cloud products, and its agreement with the Australian Bureau of Statistics for the 2021 federal census. 

  • The ABC on various matters including its national transmission services agreements with Broadcast Australia, satellite services with Optus, playout services, and various platform arrangements. 

  • Harrison.ai on a number of its joint venture arrangements. 

  • GrainCorp on various matters, including the $350m sale of its liquid terminals business, and the long-term storage agreement with ANZ Terminals for the continued use of storage capacity following the sale. 

  • The NSW Government on the $2.6b privatisation of the State’s land titling registry, including ongoing advice in relation to data and interoperability matters. 

  • Calvary Healthcare on its delivery of hospital-in-a-home services to patients across Adelaide for the south Australian Government, as part of a joint venture with Medibank. 

  • Football Australia on a range of IT, privacy and data related matters.
