Tanya Macdonald

Biography

Tanya is a partner in our Competition, Consumer and Market Regulation group.

She has over 15 years of experience advising on competition and regulatory issues in Australia, several jurisdictions in Asia-Pacific and Africa.

Tanya specialises in complex merger and competition investigations, inquiries and authorisations, and telecommunications and financial services industry regulation and competition and regulatory compliance. She has extensive experience advising clients in highly regulated industries including telecommunications, banking, insurance, superannuation and energy. She also advises clients on significant transactions and competition investigations in the fertiliser, explosives, speciality chemicals, online wagering, fresh produce and commodities sectors.

Tanya is well-known for having a deep understanding of the sector-specific regulatory landscape and market dynamics. Her ability to navigate complex regulatory frameworks and manage existing and emerging competition and regulatory risks, combined with her pragmatic approach to problem-solving, enables her to assist clients in achieving their overall strategic objectives. Her unique skill set and extensive experience has made her a sought-after competition and regulatory advisor.

Experience

Tanya’s experience includes advising:

  • Telstra on the ACCC’s investigation into Google’s search engine arrangements with third parties and Telstra’s enforceable undertaking provided to the ACCC.

  • Telstra on the competition and regulatory aspects of in its acquisition (in partnership with the Australian Government) of Digicel, the largest mobile operator in the South Pacific which included approvals across Papua New Guinea, Fiji, Tonga, Samoa, Vanuatu and Nauru.

  • Acting for the Australian Banking Association and its member banks on the following authorisation applications to the ACCC:

    • urgently enabling banks to offer a number financial relief and other support packages to customers impacted by COVID-19;

    • implementing recommendations arising from the Financial Services Royal Commission, including in relation to informal overdrafts, eligibility criteria and features basic bank accounts and interest on overdraft facilities during droughts; and

    • industry initiatives to prevent, detect, disrupt and respond to scams affecting consumers and small businesses.

  • KKR on regulatory aspects of its acquisition of a 55% interest in Colonial First State and establishment of a joint venture with the Commonwealth Bank of Australia.

  • KKR on the competition aspects of its $2.175 billion acquisition of Perpetual’s corporate trust and wealth management businesses.

  • Hollard on the regulatory aspects of its acquisition of its acquisition of CommInsure General Insurance from the Commonwealth Bank of Australia.

  • Resolution Life on the regulatory aspects of several transactions including the acquisition of AIA Australia’s superannuation and investments business.

  • Mitsubishi UFJ Trust and Banking on the competition aspects of its $2.1 billion acquisition of Link Group.

  • Stars Group on the Australian competition aspects its $6 billion global merger with Flutter Entertainment.
