Biography

Siabon is a partner in our Technology and Intellectual Property group.

She has expertise across all areas of intellectual property including copyright, trade marks, patents, designs, passing off and related trade practices law, data security and protection of trade secrets and confidential information. Siabon also leads the brands litigation practice and is highly regarded as a leading intellectual property litigator.

She has had an excellent track record of success working on enforcement matters for both national and international clients and brands across different industries including media and entertainment, fashion and luxury, software, consumer electronics, healthcare, financial services and FMCG. She has expertise in finding innovative and commercial answers to legal complexities and disputes that arise in intellectual property resulting from the digital transformation or disruption of industries, particularly in the media and entertainment space.

Siabon has litigated cases in the Supreme and Federal Courts and at appellate level in the Full Federal Court and the High Court of Australia. She also has a leading practice in the Australian Copyright Tribunal.

Experience

Siabon’s experience includes advising:

  • Acting for Lavazza in trade mark infringement proceedings brought in relation to its use of the word “Oro” as part of its leading coffee brand, Lavazza Qualita Oro.

  • Acting in a number of landmark copyright infringement proceedings which have tested the boundaries of copyright law in Australia including Kazaa, Cooper, IceTV and the Roadshow/iiNet cases.

  • Various copyright rate-setting proceedings for the music industry in the Australian Copyright Tribunal including determining the licence rates for commercial radio's online simulcast and broadcast of sound recordings.

  • Acting for leading European luxury jewellery brands (Cartier, Van Cleef & Arpels, Buccellati, Panerai, Chloe, Alaïa etc.) on market investigations and enforcement strategies to deal with lookalike products.

  • Advising State Street Global Advisers in a case over the use and promotion in Australia of a replica of its iconic Fearless Girl statue, trade mark rights and copyright in the statue.

  • Acting for former Indian cricket captain and cricket legend, Sachin Tendulkar and SRT Sports Management Pvt, in a false endorsement and sponsorship dispute on misuse of his name and likeness on sports clothing and goods.

  • Advising online marketplace Redbubble on online intermediary liability in relation to copyright and trade marks including in relation to Redbubble’s successful Full Court appeal against the Hells Angels.

  • Advising leading gaming company on two Federal Court proceedings involving breach of trade secrets and confidential information, copyright infringement and breach of contract in relation to its hit gaming products.

  • Acting for FCA US and FCA Australia (Fiat Chrysler) in proceedings filed in the Federal Court alleging misleading or deceptive conduct, passing off and design infringement by an Australian competitor about the JEEP vehicle.

  • Acting for Neutron in successfully defending the Lime micro-mobility service in highly contentious trade mark and Australian Consumer Law proceedings about the LIME mark brought by the taxi industry in the Federal Court.

  • DoorDash Inc. and DoorDash Technologies Australia Pty Ltd in trade mark, misleading/deceptive conduct and passing off proceedings coinciding with the entry of this new food delivery service into Australia.

  • Representing iconic American brand Bed Bath & Beyond Inc., in its defence of claims of trade mark infringement and misleading or deceptive conduct following the company’s online entry to the Australian market.
