Rebecca Dunn

Biography

Rebecca is a partner in our Technology and Intellectual Property group.

She is an experienced intellectual property and media law litigator who has worked on some of the leading copyright cases in Australia. Rebecca advises clients across industries including media and entertainment, technology, government and healthcare in relation to multiple IP issues.

In addition to copyright, Rebecca’s focus is on trade mark litigation, Australian Consumer Law litigation and defamation. She also has particular expertise in the online space in relation to copyright, consumer law, social media, defamation, cyber security and data protection.

Experience

Rebecca’s experience includes advising:

  • The appellants in the landmark High Court of Australia copyright infringement proceedings: Roadshow Films Pty Ltd v iiNet Ltd (2012) 286 ALR 466.

  • The respondent of IceTV Pty v Nine Network Australia Pty Ltd (2009) 239 CLR 458 – proceedings brought by a major Australian commercial television network in the High Court of Australia concerning copyright in data compilations.

  • The Record Companies of Cooper v Universal Music Australia Pty Ltd (2006) 156 FCR 380 – proceedings brought by the music industry on the authorisation of online copyright infringement.

  • Cirrus Communications Pty Ltd, Swoop Holdings Ltd and related companies – defending Swoop in a trade mark infringement dispute in the Federal Court against Carray Group trading as “Swoop Digital”.

  • Salitrosa Holdings Pty Ltd t/a Stoneworld in defending the major Australian tile retailer in copyright proceedings in the Federal Court against competitor Orientile.

  • Tolga Kumova (mining entrepreneur) in high profile Federal Court defamation proceedings against anonymous social media account @stockswami, succeeding on all claims.

  • NSW Health in Supreme Court proceedings brought by MDT Technologies in relation to ventilators provided by MDT to NSW Health during the COVID-19 pandemic.

  • C21 trading as RAMA Works, in the Federal Circuit Court and Family Court of Australia dispute against Ms Kate Hou and Hibi Design, involving copyright infringement, breach of confidence and breach of fiduciary duties.

  • Qudos Bank, in a case against its software vendor Infosys Technologies on the potential misuse of intellectual property and confidential material provided during a commercial arrangement.

  • SG Fleet on a defamation case brought by an unsuccessful interviewee via a preliminary discovery application.

  • State Street Global Advisers in a case over the use and promotion in Australia of a replica of its iconic Fearless Girl statue, trade mark and copyright in the statue.

  • Several high-profile individuals and a media industry body with ad-hoc defamation advice for potentially highly damaging allegations of defamation.
