Patrick Tydde

Biography

Patrick is a partner in our Disputes and Investigations group.

He primarily advises clients in the mining, resources, energy and infrastructure sectors.

Patrick has extensive litigation experience across Australian superior jurisdictions, appearing regularly in the Supreme Court of Western Australia and the Federal Court of Australia. Patrick has a particular focus on resolving complex contractual and commercial disputes, involving joint-ventures, mining and engineering, construction claims, Insolvency and high-value private and native title trusts.

Patrick advises clients with an eye to the full spectrum of dispute resolution tools available, pursuing formal proceedings where necessary but being open to resolving disputes where appropriate – with a focus on the client’s best commercial outcomes. Patrick is a go-to lawyer in Perth for business seeking advice and insight into approaching disputes strategically, pragmatically and with overall corporate objectives in mind. Patrick also represents clients in responding to regulatory investigations and related disputes concerning Corporations Act and trade practice matters, in Royal Commissions and Enquiries, and enforcement matters.

  • Rema Tip Top group of companies in Supreme Court of Victoria proceedings brought by Incitec Pivot Ltd for breach of contract, negligence and misleading conduct.

  • Talison Lithium Australia in its dispute with Global Advanced Metals Greenbushes relating to the world’s largest hard-rock lithium mine at Greenbushes. 

  • HealthEngine in Federal Court proceedings commenced by the ACCC.

  • Wesfarmers in respect of Kmart’s involvement in the Royal Commission into Violence, Abuse, Neglect and Exploitation of People with Disability.

  • Various companies with respect to their response to regulator led investigations, including by the ACCC, ASIC and OAIC.

  • Alto Metals, Develop Global, OZ Minerals, Sandfire, Web.com, Navitas, Deep Yellow and Nusantara in court aspects of schemes of arrangement.

  • Acciona group in relation to disputes concerning the East Rockingham Waste to Energy Project.
