Lauren Shave

Biography

Lauren is a special counsel in our Disputes and Investigations group.

Focusing on the mining and energy sectors, her practice includes complex commercial disputes, resources, mine safety, native title and administrative law. Lauren regularly appears in the Supreme Court of Western Australia, the Federal Court of Australia and before the Mining Warden. 

Lauren has considerable experience in challenges to administrative decisions in mining, planning and environmental matters. Her mine safety experience includes attending sites in the wake of an incident, assisting clients in responding to any resulting investigation and acting as counsel in proceedings brought under safety legislation.

She regularly advises on issues relating to native title and Aboriginal cultural heritage and acts in litigious native title matters. For example, she advised ACEN Renewables on native title issues in the negotiation of its landmark partnership with the Yindjibarndi Aboriginal Corporation. The partnership establishes a leading model and example of meaningful economic partnerships with traditional owners in Australia.

Lauren is also the immediate past President of the WA Branch of the Energy & Resources Law Association (formerly AMPLA) and sits on the Editorial Board of the Australian Resources and Energy Law Journal.

Experience

Lauren’s experience includes advising:

  • All types of disputes under the Mining Act 1978 (WA), including tenement applications and objections, exemption and forfeiture proceedings, as well as judicial review of decisions of the Mining Warden and the Minister for Mines. Recent superior court decisions that Lauren has acted in include:  

    • Wyloo Metals Pty Ltd v Quarry Park Pty Ltd [2024] WASCA 38

    • Thompson v Siberia Mining Corporation Pty Ltd [2021] WASCA 115

    • Siberia Mining Corporation Pty Ltd v O’Sullivan [2020] WASC 214

    • Carnegie Gold Pty Ltd v Maughan [2018] WASC 366

    • Brewer v John Francis O’Sullivan, Warden at Kalgoorlie [No 2] [2017] WASC 269  

    • Siberia Mining Corporation Pty Ltd v Wilson [2015] WASC 322.

  • Assisting mine operators and service providers in relation to mine safety incidents and investigations under the Mines Safety and Inspection Act 1994 (WA) and more recently under the Work Health and Safety Act 2020 (WA), including appearing as counsel where a prosecution is brought.

  • ACEN Renewables on native title issues in the negotiation of its landmark partnership with the Yindjibarndi Aboriginal Corporation for the development, ownership and operation of large-scale renewable energy projects valued at over $1bn. The partnership establishes a leading model and example of meaningful economic partnerships with traditional owners in Australia; 

  • On a confidential water agreement between a project proponent and Traditional Owners.

  • On allegations of breach of a reasonable endeavours obligation in Gillett v Menzies Hold Co 4 Pty Ltd [2024] WASC 78;  

  • The successful party in Thaluntha Pty Ltd v CITIC Pacific Mining Management Pty Ltd [2019] WASC 196, in which the Supreme Court determined that an agreement with a (now) deregistered native title claim group was not enforceable.

  • The successful party in Marindi Metals Ltd v Kidman Resources Ltd [2017] WASC 189, involving an allegation of breach of a binding contractual obligation to acquire the lithium rights to a project that was valued at $200 million.

  • Onslow Salt Pty Ltd in a claim by the Buurabalayji Thalanyji Aboriginal Corporation for damages for a perceived change of use of particular interests that were allegedly outside the scope of what was contemplated in the relevant native title agreement: Buurabalayji Thalanyji Aboriginal Corporation RNTBC v the State of Western Australia and Onslow Salt Pty Ltd WAD 341 of 2017.
