Antonia Garling

Biography

Antonia is a partner in our Disputes and Investigations group.

She is a commercial litigator with a broad disputes and regulatory practice. Antonia is recognised by Doyle's Guide as a leading commercial litigation and dispute resolution lawyer. 

Antonia has extensive experience advising and representing clients in relation to contentious regulatory enforcement action, regulatory investigations, complex commercial disputes and class actions. She has acted for clients in matters against ASIC, the ACCC, AUSTRAC and APRA.

Antonia often acts for clients in complex and large-scale disputes and investigations which has led her to represent clients in Federal and Supreme Courts, including at all appellate levels, domestic arbitrations and regulatory investigations. Antonia also advises clients on a range of matters, particularly in relation to contract interpretation and misleading and deceptive conduct.

Antonia acts for clients in a wide range of sectors, including energy, manufacturing, and resources, but has particular expertise in financial services.

Antonia’s experience includes advising:

  • An ASX-listed manufacturing client in a high-value confidential commercial arbitration concerning the proper interpretation of a commercial contract and restraint of trade.

  • Virgin Australia in defending a class action brought by noteholders in the Federal Court of Australia.

  • A leading payments and data services provider regarding a regulatory investigation into scams and fraud in real-time payment systems.

  • A range of publicly listed Australian companies in ACCC, ASIC and AUSTRAC enforcement proceedings including BlueScope Steel, the Commonwealth Bank and Tabcorp.

  • New Hope Group in successful NSW Supreme Court and NSW Court of Appeal proceedings against Wiggins Island Coal Export Terminal over a $155 million debt guarantee dispute.

  • Gina Rinehart in defending arbitrations worth over $20 billion.

  • Velocity Frequent Flyer in Supreme Court of Queensland proceedings against BP (Australia) over their partnership agreement.

  • Patrick Terminals in Federal Court proceedings against the Port of Melbourne over a long-term lease, alleging misleading and deceptive conduct and unconscionable conduct.

  • Macquarie Bank in proceedings commenced by the BrisConnections companies against Arup in the Federal Court of Australia relating to Brisbane’s AirportLink toll road.

  • GPT Group in defending a securities class action commenced in the Federal Court of Australia.

  • AusNet Services in its defence of a class action commenced in the Victorian Supreme Court arising out of the Black Saturday bushfires.
